Terms
Booking terms.
These terms apply to bookings of beach umbrellas, sunbeds, chairs and deckchairs at PICIACIA - Spiaggia 46 in Bellaria-Igea Marina and to related services (bringing your dog, the Extras ordered for your arrival, online payments, bank transfers and invoices), whether requested through this website, by email or by phone, and to the “A summer by the sea” gift vouchers. Please read them before sending a request or buying a voucher: once we confirm your booking, or issue the voucher, they become part of our agreement.
Who provides the service
The service is provided by PICIACIA di Vasini Piero & C. S.n.c., registered office at Via Adriatico 49, 47814 Bellaria-Igea Marina (RN) and place of business at the PICIACIA - Spiaggia 46 beach establishment, Via Cristoforo Colombo, 47814 Bellaria-Igea Marina (RN), Italy; VAT number IT03807680404; tax code (codice fiscale) and Companies Register number of Romagna – Forlì-Cesena e Rimini: 03807680404; REA no. RN-309400 (Economic and Administrative Index). You can reach us at info@piciacia.it or on +39 0541 344888.
Request and confirmation
The form on this website sends a request, not a booking: it commits neither you nor us.
Your booking is confirmed only when we send you our confirmation, usually by email, with the dates, the services and the price; if, before confirming it, we ask you for a deposit (caparra confirmatoria), the booking is confirmed when we receive the deposit (see “Deposit (caparra confirmatoria)”). Please check the confirmation as soon as you receive it and, if anything is wrong, reply to the same email.
We assign the row and the spot. If, for safety reasons or by order of the authorities, we have to change a confirmed spot, we will let you know and give you an equivalent one.
Prices
The price is the one stated in the confirmation, based on the season’s price list: it is the final price, VAT included, for the services listed in the confirmation. Extra services are paid separately at the prices in force, which you can ask us for before using them; a dog costs €4 per day (see “Dogs”). The price list may change from one season to the next, but the price of a confirmed booking does not change (except a price stated as provisional, see “Provisional price”); if you change dates or services, we recalculate the price and confirm it to you first. The Extras for your arrival cost the prices shown on the order page (see “Extras for your arrival”).
Provisional price
If the season’s price list has not been published when you book (it is set each year by the beach establishments’ cooperative), we may confirm your booking at the price calculated on the previous season’s list, stated as “provisional” in the confirmation. As soon as the new list is out, we tell you the definitive price by email (or on WhatsApp), for the same service and the same dates. If it is the same or lower, the definitive price applies. If it is higher, we may keep the provisional price or ask you for the definitive one: in that second case you may cancel the booking at no cost by replying within 14 days of the day our message reaches you, and in any case by the day before arrival; we refund everything you paid, deposit included, within 14 days of your reply, by the same means of payment (for a bank transfer, to the account you give us). If you do not cancel within that period, the booking stays valid at the definitive price. If we do not tell you the definitive price at least 15 days before the day of arrival, the provisional price remains in force. The price of a booking not stated as provisional does not change.
Payment
As a rule you pay at the beach on arrival, for the whole stay, in cash or by card, less anything you have already paid in advance: a deposit (caparra confirmatoria), an online payment or a gift voucher (see below). In some cases, before confirming the booking, we may ask you for a deposit (see “Deposit (caparra confirmatoria)”).
If we offer it, you may also pay for the whole stay or the Extras online in advance: that is your choice and, if you do not, you pay on arrival. Each payment link is valid until the date written in the email or message that brings it and only for the amount shown: if the amount due changes in the meantime, the link stops working and we write to you with the right one.
Online payments are made on PayPal’s secure page (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg), with your PayPal account or with a card, even without an account. You enter your card and account details on PayPal’s page and PayPal processes them: they never reach us. Amounts are in euros, VAT included; we add no charge for paying online. Any currency conversion or bank charges depend on PayPal or your bank.
An online payment counts from when PayPal confirms it to us as completed; if PayPal holds it for review, it counts from when PayPal confirms it. If we have your email address, we send you a confirmation by email. What you have paid in advance (the deposit, online or with a gift voucher) is deducted from the price: on arrival you pay only the balance. What is written in the confirmation and in our payment messages, by email or on WhatsApp, always applies.
If an online payment does not go through, including because of a technical problem on our side or PayPal’s, you can try again later: a payment that was not completed is not due; if you still see a charge or an amount on hold, write to us before paying again. If the deadline for the deposit is near and online payment does not work, write to us or call us before the deadline: we will offer you another way to pay it (for example a bank transfer) and, if the problem is not on your side, we will move the date.
When we refund a payment made with PayPal, we normally also email you the amount, the date and the reference of the refund. The money goes back to the PayPal account or card you used, usually within a few days; for cards it can take up to 30 days, depending on the bank. We make the refund within the time limits set out in these terms: how long it takes to reach you depends on PayPal and your bank, not on us.
We will never ask for your card details by email, by phone or in a message. Our payment links reach you only from us: in our emails or on WhatsApp from our number +39 0541 344888, as an ordinary message or as a WhatsApp-approved message with a button to pay the deposit. Their address always starts with https://www.piciacia.it/ (for example https://www.piciacia.it/en/payment/…): they open a page on our website and from there, if you pay online, PayPal’s page (www.paypal.com). If you receive any other request in our name, or a link with a different address, do not pay and let us know.
The same goes for bank details. Ours (account holder PICIACIA di Vasini Piero & C. S.n.c.) reach you only from us: in our emails from our address info@piciacia.it, on WhatsApp from our number +39 0541 344888 or on a page of our website starting with https://www.piciacia.it/. We never tell you of a change of our IBAN by message: if you receive bank details in our name that differ from those we gave you, or a notice that our account has changed, do not pay, and call us on +39 0541 344888 or write to info@piciacia.it, using the contact details on this website, not those in the message. Before making the transfer, check that the account holder is PICIACIA di Vasini Piero & C. S.n.c..
If a payment looks wrong to you, please write to info@piciacia.it first: we usually sort it out quickly. If you open a dispute or ask PayPal or your bank for a chargeback, we may give them evidence of the booking, the confirmation and the service; the rights the law gives you are not affected.
Deposit (caparra confirmatoria)
When we ask for it, the deposit (caparra confirmatoria, Article 1385 of the Italian Civil Code) is 40% of the price, rounded down to the nearest €5, or the amount we state in our reply. We tell you so in our reply and send you the deposit request, by email or on WhatsApp, with the link to our payment page, the way or ways you can pay it (online with PayPal or by card, or by bank transfer) and the date by which to pay it: as a rule 7 days from when we send you the request or, if you arrive sooner, the day before arrival; the date written in the message applies. The deposit request counts only from when it has reached you. Before the deadline we may send you a reminder (usually 2 days before). Until the deposit arrives, the booking is registered but not yet confirmed; if it has not arrived by that date, we may cancel the booking. If we ask for it after your booking has already been confirmed to you, the booking stays confirmed and the deposit is to be paid by the date written in the message.
If the request offers the bank transfer, the message and the payment page show the account holder, the IBAN and the payment reference (for example “Caparra prenotazione PIC-1234-4 Rossi”): make the transfer to that account, for the amount shown, and write the payment reference exactly as shown, because we need it to recognise your payment. A deposit paid by bank transfer counts as received when the amount is credited to our account, not when you order the transfer: that is the moment that counts for the date by which to pay it. A standard transfer usually takes 1–2 working days to arrive: please make it in good time and, if the date is close, we suggest an instant transfer, if your bank offers one. When the amount arrives, we send you a confirmation (“Bank transfer received”). We add no charge for the bank transfer; any fees charged by your bank are yours to pay. If an amount different from the one requested arrives, we write to you to settle the difference; if the amount arrives when the booking has already been cancelled, we return it to you by bank transfer.
The deposit confirms the booking; if you cancel after the stated deadline, it is not returned (Article 1385 of the Italian Civil Code), except as provided under “Provisional price”. The deadline is 14 days before the day of arrival (for example 18 July for an arrival on 1 August) and is also shown on the payment page.
If you cancel after that deadline, or do not arrive (see “Changes and cancellations”), we keep the deposit, as Article 1385 of the Italian Civil Code provides; if you shorten your stay, the same rule applies to the cancelled part. If instead you cancel or shorten your stay at least 14 days before the day of arrival, we return in full the deposit paid for the cancelled part: this is a more favourable condition than the law provides, which we grant you. The cancellation provided for under “Provisional price” is a further exception: in that case we return the deposit even if you cancel less than 14 days before arrival.
If it is we who fail to provide the booked service through our own default (for example if we cancel your confirmed booking for reasons not attributable to you and not due to force majeure), you may ask us for double the deposit (Article 1385 of the Italian Civil Code): we return the deposit and pay you an equal amount on top; anything else you paid in advance we refund in full.
When we have to return a deposit paid by bank transfer (or pay you double), we do so by bank transfer to the account you tell us: for this we ask you, by email or in a message, for the IBAN and the account holder. We make the transfer within the time limits set out in these terms (see “Changes and cancellations”); if we receive the IBAN later, the time limit runs from when you give it to us. Please check the IBAN carefully: a refund made to the account you indicated counts as made. We refund without deductions: our bank’s fees for the refund are ours to pay; how long the credit takes depends on the banks.
If you arrive and use the service, the deposit is deducted from the price: on arrival you pay only the balance.
Invoices
If you need an invoice (fattura), ask for it no later than when you pay: Italian law requires this (Article 22 of Presidential Decree 633/1972). The payment page for the stay, the balance and the Extras asks you, before you pay, whether you need one; the deposit page and the gift voucher form on this website do not ask for now: in those cases, write to us before paying; if you pay at the beach, tell us before paying. You can also ask us by email at info@piciacia.it or by phone on +39 0541 344888, again before paying. If you do not ask, we give you the ordinary sales receipt (documento commerciale, the “scontrino”), and we may decline to issue an invoice requested after payment.
We ask only for the data needed, depending on who the invoice is made out to. Private individual resident in Italy: first name, surname, Italian tax code (codice fiscale) and address (email or PEC optional). Business or professional in Italy: company name, VAT number (partita IVA), tax code (optional), registered office and, if you have them, SDI recipient code or PEC (without them, the invoice reaches you in your cassetto fiscale, your online tax area with the Agenzia delle Entrate). Entity without a VAT number: name, tax code and address. Private individual resident abroad: first name, surname, country, address, email and, if any, the tax ID of their country. Business in the European Union: company name, VAT number with the country prefix, address and email. Business outside the European Union: company name, address, email and, if any, tax ID.
We use the data exactly as you give it: please check it before paying, as you are responsible for its accuracy. An invoice once issued cannot be changed: correcting it may require a credit note and a new invoice. We are not responsible for the consequences of wrong or incomplete data you have given us.
Prices include VAT (22% for the beach service and gift vouchers): an invoice does not change the amount to pay. It is an electronic invoice, sent through the Italian Revenue Agency’s Exchange System (Sistema di Interscambio, SdI); we also email you a courtesy copy, if you gave us an email address.
Changes and cancellations
If your plans change, please let us know as soon as possible from the “Would you like to change something?” page (the link is in the booking summary and in the reminder), by replying to the confirmation email, writing to info@piciacia.it or calling +39 0541 344888, so that we can offer the spot to other guests. A request to change or cancel counts from the moment we receive it. Changes are accepted subject to availability and are valid only once we confirm them to you by email, with the new price: if the price goes up, you pay the difference at the beach on arrival or, if the confirmation email contains a PayPal link, online with that link; if you shorten your stay, the cancellation rules below apply.
If you have not arrived by 2 pm on the first day of your booking and have not told us, we will try to reach you at the email address or number you gave us; if we have not heard from you by the end of that day, we may treat the whole booking as cancelled and give the spot to other guests. If you then arrive on a later day, we will give you a spot only if one is free.
Cancelling a booking paid in advance, with the deposit (caparra confirmatoria), online or with a gift voucher: if you cancel or shorten your stay at least 14 days before the day of arrival (for example by 18 July for an arrival on 1 August; for online payments the date is also written in the payment email), we refund in full what you paid for the cancelled part, deposit included, with no deductions, by the same method (for PayPal, to the account or card you used; for a bank transfer, by bank transfer to the IBAN you give us: see “Deposit (caparra confirmatoria)”), within 14 days of the cancellation: for the deposit this is a more favourable condition we grant you (see “Deposit (caparra confirmatoria)”). An amount paid with a gift voucher is instead credited back to the voucher, which becomes usable again for a new booking, never in cash (if the voucher has expired or expires within 30 days, it becomes valid until the end of the following season: see “Gift voucher”). Extras already paid for are refunded only if you cancel the whole booking by the same deadline (or in the case described under “Provisional price”): see “Extras for your arrival”.
If you cancel or shorten your stay later, or do not arrive (see above), what you have already paid for the cancelled part, deposit included, is not refunded, because at that point the spot is unlikely to be re-let; we do not, however, ask you for the rest of the price. Bad weather is not a reason for a refund: see “Bad weather”. If we manage to give the spot to someone else, we may, at our discretion and without obligation, offer to move your dates or to use the amount for another stay in the same season. The cancellation provided for under “Provisional price” is an exception: in that case we refund everything you paid.
If we cancel a confirmed booking for reasons not attributable to you and not due to force majeure, we refund in full what you paid, by the same method, within 14 days (an amount paid with a gift voucher is credited back to the voucher, as explained under “Gift voucher”); if you paid a deposit (caparra confirmatoria), you may also ask us for an amount equal to the deposit, that is, double the deposit in all (see “Deposit (caparra confirmatoria)”).
Refunds are made by us and do not start by themselves: to cancel, use the “Would you like to change something?” page, write to us or call us, and we will confirm the cancellation, the amount and the method of the refund by email.
Right of withdrawal
For leisure services booked for specific dates, such as the hire of beach umbrellas and sunbeds, the law does not provide for the right of withdrawal that applies to distance contracts (Article 16(l) of Directive 2011/83/EU; Article 59(1)(n) of the Italian Consumer Code). You can still cancel as explained above. Nor is there a right of withdrawal for Extras made of food, drinks, flowers or other goods that deteriorate quickly (Article 16(d) of the Directive; Article 59(1)(d) of the Italian Consumer Code), which we deliver to your umbrella on a specific date (Article 59(1)(n)), or for newspapers and magazines (Article 16(j) of the Directive): see “Extras for your arrival”. For any other kind of Extra you may withdraw within 14 days of delivery by returning it intact, and we refund its price.
A gift voucher, including a package, bought at a distance (on the website, by email or by phone) is not tied to dates: you may withdraw from the purchase within 14 days of the day you buy it, that is, the day the payment is completed, without giving any reason (Article 9 of the Directive; Article 52 of the Italian Consumer Code), only if the voucher has not been used, not even in part. A clear statement sent to info@piciacia.it is enough (you may also use the model withdrawal form of Annex I(B) of the Directive): we refund everything you paid, by the same payment method, within 14 days of receiving your statement, and cancel the voucher. After the 14 days the voucher is no longer refundable, even if you have not used it. Once used for a booking, even in part, the voucher is part of a service for specific dates, for which there is no right of withdrawal. A voucher bought in person at the beach is not a distance purchase: there is no right of withdrawal for it.
Bad weather
The weather by the sea is beyond our control. As a rule the beach stays open, with our staff at work, even when the weather is bad, and you are welcome to stay on the beach even in the rain. So, when the beach is open and your spot is available, bad weather, rain, wind or a bathing ban do not entitle you to a price reduction or a refund.
We are not liable for inconvenience caused by events beyond our control, such as orders of the authorities, storm surges, beach erosion or interruptions of public services. This does not affect your statutory rights as a consumer.
At the beach
During your stay, the bathing regulations in force (regional and municipal) and the instructions of the beach staff apply.
Please use umbrellas, sunbeds and equipment with care, do not move them from your assigned spot without asking us, and respect the peace of other guests.
If anyone seriously or repeatedly breaches these rules or endangers safety, after a warning we may ask them to leave the beach; in that case only the days already enjoyed are charged.
Dogs
Dogs are welcome. They cost €4 for each day the dog comes to the beach; days when it does not come are not charged. We give your dog a free welcome kit with kibble, a water bowl and waste bags. If you are bringing your dog, please tell us in your request.
The bathing regulations of the Emilia-Romagna Region and of the Municipality of Bellaria-Igea Marina currently in force apply, together with these rules: the dog must always be on a lead and under the control of its owner or of the person accompanying it, who must carry a muzzle to use if needed; droppings must be picked up immediately; the dog may swim in the sea only where and when the regulations allow it. Please bring your dog’s documents (microchip and registration in the dog register or, for dogs coming from abroad, the equivalent documents).
The dog’s owner, or whoever has it in their care, is liable for it under the law (Article 2052 of the Italian Civil Code), including for damage to people, animals and equipment. If a dog disturbs other guests or behaves aggressively, we may ask for it to leave the beach; if you then leave with it, only the days already enjoyed are charged.
Belongings, children and damage
The beach does not provide a safekeeping service: do not leave valuables under your umbrella or unattended on the beach.
Children remain under the supervision of their parents or of the adults accompanying them, including in the playground and the baby club.
You are liable for damage caused by you, the people with you or your dog to umbrellas, sunbeds and equipment beyond normal use.
Nothing in these terms limits our liability for personal injury, wilful misconduct or gross negligence, or the rights that the law grants to consumers and that cannot be excluded.
Extras for your arrival
After your booking is confirmed, our emails contain a personal link to order a few products (for example a chilled bottle, fruit or flowers, with a gift note if you like) waiting under your umbrella on the day you arrive. The Extras are sold and delivered by PICIACIA - Spiaggia 46, not by the Coconut bar. Products, descriptions and prices, VAT included, are those shown on the order page when you order; we confirm your order by email.
You can order Extras through the link until 6 pm on the day before arrival and, as long as you have not paid for them, change or cancel the order by the same time; after that time the order can no longer be changed through the link: for a last-minute change call us, and we will accept it if we can. Extras follow the booking: if the dates change, we prepare them for the new day of arrival; if the booking is cancelled, the Extras not yet paid for are cancelled too (for those already paid for, see below).
We bring them to your umbrella on the day of arrival, once you are on the beach. If a product is no longer available, we let you know and you do not pay for it (or, if you have already paid, we refund it); if you wish, we suggest a similar product.
They are paid on arrival, together with the umbrella, or online in advance if you choose to (see “Payment”). Extras of food, drinks and flowers deteriorate quickly and are prepared for you for a specific day: once paid for, they cannot be cancelled or refunded if you change your mind about the Extras, nor if you cancel the booking less than 14 days before the day of arrival or do not arrive (Article 59(1)(d) and (n) of the Italian Consumer Code). We refund them in full only if you cancel the whole booking at least 14 days before the day of arrival (the same deadline as for the deposit), if you cancel the booking as provided under “Provisional price”, or if it is we who cannot provide them: if a product is no longer available, if we cancel the booking, or if for a reason on our side we do not deliver them.
Products containing alcohol: we sell them only to adults. To order them you must declare that you are at least 18, and we hand them only to an adult, whom we may ask for ID. We do not hand them to anyone who looks underage and has no ID, or who appears drunk (Article 14-ter of Italian Law 125/2001; Article 689 of the Italian Criminal Code): in that case you do not pay for them or, if already paid, we refund them. Please drink responsibly.
We deliver your gift note with the product exactly as you wrote it: the people with you will be able to read it. We do not deliver notes that are offensive or unlawful.
“A summer by the sea” gift voucher
The voucher can be bought on the website, by email, by phone or at the beach, for an amount from €20 upwards (up to €1,000 on the website) or for a package. We issue it, with a unique code (for example PCC-7F3K-92QM), when we receive the payment: with PayPal as soon as PayPal confirms it, by bank transfer when the amount reaches our account, at the beach straight away. We email it to the buyer, with a PDF to print and give, and, if you ask, also straight to the recipient (see below). The PDF shows the recipient’s name, the message, the code, a QR code and the expiry date; it shows the amount only if you choose “With the amount” when you buy (for a package: its name and, with that choice, its price), otherwise not, so you can give it discreetly. The value is always in the buyer’s email and on the voucher page. The QR code is for our staff: it opens the voucher’s record in our internal panel, which only staff can access; to use the voucher, the code is enough.
It is valid until the last opening day of the season in progress when you buy it. If you buy it in the last 30 days before the season closes, or once the season has closed, it is valid for the whole following season, until its last opening day (for example: bought on 29 September, it is valid for the whole of the next summer). The last opening day is the last day of our price list for that season; if the price list is not yet published, it is 30 September. We show you the exact expiry date on the website before you pay, and it is written in the email, on the voucher page and in the PDF: the date written on the issued voucher applies, even if we later change our opening dates. If the payment arrives after the request (for example by bank transfer), the expiry date can only move later, never earlier. It can be used for stays that start by the expiry date.
The umbrella must always be booked. To use the voucher or package, first book your umbrella through our official channels (the booking form on www.piciacia.it, by phone on +39 0541 344888 or by email at info@piciacia.it) and give us the code. The voucher gives no right to a spot or to particular dates: our confirmation of the booking applies, subject to availability. At the busiest times (July, August and long weekends) anyone who turns up at the beach without a booking may not find a place: in that case the voucher remains valid until its expiry date for another booking, but the lack of a place gives no right to refunds, an extended expiry date or any other compensation.
Whoever buys the voucher on this website gives us their own data (name, address, country and, for residents of Italy, the Italian tax code) and declares that it is true and theirs. If it turns out to be false or someone else’s, we may decline to issue the voucher, or cancel it if it has not yet been used, returning what was paid by the same method. We process this data as explained in the privacy notice.
It is used for the beach service of PICIACIA - Spiaggia 46 (umbrella, sunbeds, chairs and deckchairs) by giving the code when you book or at the latest on arrival; it is not valid for Extras, the Coconut bar or other services. It is used once, in full, in a single booking: if the stay costs more, you pay the difference; if it costs less, the difference is not refunded, does not stay on the voucher, and the voucher is used all the same. Bookings paid with the voucher follow these terms and the season’s price list; the voucher does not guarantee the availability of dates or spots, which are booked as usual.
A package (for example “1 umbrella and 2 sunbeds · 2 days”) is worth its price in euros towards the beach service. Its name and description say what it is meant for, but a package is not a booking: it does not guarantee dates or spots, which are booked as usual, and the stay is paid according to the season’s price list. It is used in a single booking: if the stay costs more, you pay the difference; if it costs less, the difference is not refunded and the voucher is used all the same. The value of the package is the one stated at the time of purchase and does not change if the price list changes; we also say so on the website, before you pay.
The voucher, including a package, cannot be exchanged for cash, gives no change and is not refundable. The only exception is withdrawal from a distance purchase, within 14 days of payment and only if the voucher has not been used, not even in part (see “Right of withdrawal”): after the 14 days it is no longer refundable, even if you have not used it. If the stay costs less than the voucher, the difference gives no right to change, refunds or other vouchers. Whenever the amount of a booking paid, even only in part, with the voucher is to be given back (for example if you cancel in time or if we cancel the booking), the amount paid with the voucher is always credited back to the voucher, never paid out in cash: the voucher becomes usable again, still only once, for the whole value it had; if by then the voucher has expired or expires within 30 days, its validity is extended to the last opening day of the following season. If you do not use it by the expiry date, the voucher is lost and is not refunded: this is why we show you the expiry date before you pay and write it in the email, on the voucher page and in the PDF.
Delivery to the recipient. When you buy the voucher on the website you can ask us to email it straight to the recipient: you give us their address and declare that you are entitled to give it to us and to have them receive this gift. We send the voucher to that address as soon as it is issued or, if you choose a day, on the morning of that day, from 10 am (if the payment arrives on that day or later, as soon as the voucher is issued, but never at night, between 10 pm and 8 am: in that case in the morning, from 10 am). We send it only once, unless you ask us to send it again; we always send you a copy. Please check the address carefully before paying: we are not liable for incorrectly entered addresses, for emails stopped by spam filters or full mailboxes, or for emails that are not read. If we notice that the email was not delivered, we try to let you know, so that you can give the voucher to the recipient yourself; you can also ask us to send it again. Once sent to you and to the address you gave us, the voucher has been delivered: direct delivery is a convenience, and the chosen day does not change the expiry date or any other rule of the voucher.
The voucher is a bearer voucher: whoever has the code can use it, even if they are neither the buyer nor the person named on it. Keep it private: we are not liable for the use of the code by others, even when they read it in a forwarded email or in one sent to the address you gave us. If it is lost, the buyer can ask us to send it again to the email used for the purchase; if you tell us the code has fallen into the wrong hands and it has not yet been used, we may cancel it and give you a new voucher for the same value and with the same expiry date.
For withdrawing from the purchase see “Right of withdrawal”; for cancelling a booking paid with the voucher see “Changes and cancellations”; for an invoice see “Invoices”: if you need one, ask for it before paying.
Calendar and Wallet pass
In our booking emails we may offer you a file to add to your calendar and a pass for Apple Wallet (iPhone) or Google Wallet (Android) with the dates, the service and, if already assigned, the row and the spot. They are optional conveniences. The Wallet pass updates itself when your booking changes, but the update depends on the network and on Apple’s and Google’s services and may arrive late; the calendar file is up to date at the moment you download it. Weather and sea temperature are third-party forecasts (Open-Meteo), for guidance only; the flag shown in the pass is a reminder: on the beach the flag actually flying and the lifeguard’s instructions always apply. The booking confirmation always prevails. Calendars, Apple Wallet and Google Wallet are third-party services, which you use under their own terms.
Flag, lifeguards and swimming
The flag and notices shown in the Wallet pass, or in a message from us, are only an optional reminder: we may not update them (because of a fault, the network, staff busy on the beach, or an oversight) and they may arrive late or not at all. Do not use them to decide whether to swim: only the flag flying on the beach, the signs and the lifeguard’s instructions ever count. The lifeguard service runs only in the period and at the hours set each year by the bathing ordinance (usually from 9:30 to 18:30); from 12:30 to 14:30 the lifeguards take their break in turns and the service is ensured in rotation between neighbouring stations (red flag): swim in front of a manned lifeguard tower. Outside those hours and that period there is no lifeguard service, even when the beach is open: the double red flag is flying, swimming is unsupervised and we advise you not to go into the water. If you choose to swim unsupervised, or against the flag and the lifeguard’s instructions, you do so at your own responsibility and must watch over any minors with you. To the extent permitted by law we are not liable for damage arising from swimming outside the service hours, from not respecting the flag or the lifeguard’s instructions, or from a flag or notice in the pass that is out of date, late or missing. This does not affect your statutory rights as a consumer or our liability for wilful misconduct or gross negligence.
Complaints and governing law
If anything is wrong, tell our beach staff straight away, so that we can put it right during your stay; you can also write to us at info@piciacia.it and we will reply as soon as possible. These terms and all bookings are governed by Italian law, since the service is provided entirely in Italy; this does not affect the consumer protection rules that cannot be excluded by contract. If you are a consumer resident in Italy, the court of your place of residence has jurisdiction (Article 66-bis of the Italian Consumer Code); if you live in another EU country, you may also bring proceedings before the courts of your country (Regulation (EU) No 1215/2012).
Languages and updates
These terms are published in Italian, English, German and French; if the versions differ, the Italian text prevails. We may update them: each booking is governed by the terms in force when we confirmed it.
